A 35-year-old man faces a felony battery-with-prejudice charge after Surfside police said he directed antisemitic remarks at a couple walking on Harding Avenue, punched one of them in the head and threatened to kill him.

Police arrested Jorden Stephen Perozo on Wednesday, Aug. 19, at his workplace, Flanigan’s Bar & Grill on Harding Avenue. He was taken into custody without incident, WSVN reported, citing an arrest report.

The attack happened Sunday night, Aug. 16, along the 9500 block of Harding Avenue. According to the arrest report, the victim and his wife were crossing the street when Perozo approached on an electric scooter and began directing profanity at them and the Jewish community.

The victim tried to walk away.

Investigators said the confrontation escalated when Perozo punched the victim on the side of the head with a closed fist and threatened to kill him. Perozo continued yelling profanities and derogatory remarks after the punch, according to the report. The victim’s wife recorded the encounter on her cellphone.

Perozo was charged with battery with prejudice and harassment or intimidation based on religious or ethnic heritage. A judge found probable cause, set bond at $6,000 and ordered him to stay away from the couple.

Under Florida Statute 775.085, a first-degree misdemeanor may be reclassified as a third-degree felony if the offense evidences prejudice based on a victim’s protected characteristic. A third-degree felony carries a maximum sentence of five years in prison, according to the Miami-Dade State Attorney’s Office.
